TERMS AND CONDITIONS OF SALE

GENERAL

These terms and conditions govern sales by Sacré-Shop, on their website www.sacre-shop.ch. These conditions apply to the exclusion of all other conditions.

1 – PRICES

Prices are quoted in Swiss francs (CHF) excluding VAT. Until further notice, VAT is not charged.

In the case of orders to countries other than Switzerland, the buyer is the importer of the item(s) concerned. Customs duties, import duties, state taxes and other local taxes may apply. These rights and sums are not the responsibility of Sacré-Shop. They will be borne by the purchaser and are his sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in his country. Buyers are advised to check with their local authorities.

All orders are invoiced and payable in Swiss francs (CHF).

Items are invoiced on the basis of the rates in force at the time the order is placed.

The items remain the property of Sacré-Shop until full payment of the price.

2 – ORDER

Orders are placed via the www.sacre-shop.ch website.

Sending an order implies the buyer’s acceptance of these terms and conditions in their entirety, to the exclusion of any other terms or conditions.

Any person placing an order on the site declares that he/she is 18 years of age and has the legal capacity or, failing this, parental authorization to enter into the contract.

Sacré-Shop reserves the right to refuse the order of a buyer.

3 – VALIDATION

A confirmation is sent to the buyer by e-mail. Shipment takes place on receipt of payment.

4 – AVAILABILITY OF ITEMS

If an item is no longer available or out of stock with its suppliers, Sacré-Shop informs the buyer promptly, mentioning the approximate waiting time.

In the event of partial availability of an order, the entire order will be put on hold (to avoid additional shipping costs). If the purchaser still wishes to receive the items already in stock without waiting for the entire order, please contact customer service to find an arrangement (the additional postage costs for the^2nd shipment will then be borne by the purchaser).

5 – PAYMENT

Payment can be made by credit card, Paypal, Stripe or prepayment by bank transfer.

If the buyer chooses the prepayment option, the goods are reserved for 5 days. He therefore has this period to make his payment to Sacré-Shop’s bank account. If this is not the case, the merchandise is once again available for reservation.

6 – DELIVERY TERMS, DELIVERY TIMES AND SHIPPING COSTS

Shipping costs include packaging, processing and postage.

The shipping costs indicated in the order confirmation are those invoiced. Sacré-Shop guarantees adequate packaging for postal transport. It declines all responsibility for any damage caused during postal transport. If the packaging arrives damaged, the claim must be made directly to the post office.

An article that is not in stock will be sent as soon as Sacré-Shop receives it. In this case, an e-mail will be sent to the buyer indicating the approximate delivery date (which may vary depending on the item).

Items ordered are sent by Swiss Post as “Priority” or “Economy”. The type of shipment (letter or parcel) is also at Sacré-Shop’s discretion.

Packages/letters are sent to the exact address given and validated at the end of the order. Sacré-Shop is not responsible for errors in address information. In the event of the package being returned due to an error, incomplete address or non-receipt of the package by the purchaser, the cost of returning the package as well as all inherent costs will be re-invoiced.

Delivery is deemed to have taken place as soon as the item has been made available to the carrier, who is responsible for delivering it to the buyer.

7 – CONFORMITY OF ITEMS AND EXCHANGES

Sacré-Shop guarantees the quality and control of the item as it leaves the store, according to the standards of the distributors/suppliers.

Sacré-Shop undertakes to exchange an item apparently defective, damaged or damaged or not corresponding to the order.

Sacré-Shop thanks the buyer to kindly report in detail by email and take note of the terms of return. The item must be returned with the delivery note or order confirmation. The replacement item will be sent on receipt of the returned goods.

Shipping costs for returned goods are at the buyer’s expense.

The provisions of this article do not prevent the purchaser from benefiting from the right of withdrawal (satisfied or reimbursed) provided for in article 8.

8 – SATISFIED OR YOUR MONEY BACK

The buyer has a period of 10 days from receipt to return the item.

The buyer will then be responsible for return shipping costs.

Returns must be made in their original packaging, complete and in good condition. Please notify Sacré-Shop by email. The item must be accompanied by the delivery note or order confirmation.

Items returned incomplete, damaged or soiled by the buyer will not be taken back.

Only the value of the goods will be refunded. Shipping costs for returned goods are at the buyer’s expense.

9 – REIMBURSEMENT

Refunds for items covered by the previous point will be made within 30 days or less of receipt of the goods by us.

The refund will be made by Sacré-Shop on the bank account of the buyer at the billing address.

11 – INTELLECTUAL PROPERTY AND OTHER

Sacré-Shop owns and operates the www.sacré-shop.ch portal. All texts, comments, works, illustrations and images and other elements appearing on this site are reserved under copyright and intellectual property law for the entire world. No rights (rights of use, intellectual property, etc.) are derived from consulting, downloading or copying pages of the site. The total or partial reproduction, transmission (electronically or by other means), modification, use of the portal, or the addition of links on or to it for public or commercial purposes is strictly forbidden.

12 – LIABILITY

Sacré-Shop cannot be held responsible for non-compliance with the legislation of the country where the items are delivered. It is the buyer’s responsibility to check with the local authorities regarding the possibility of importing or using the items or services he/she intends to order.

Photos are for illustrative purposes only. Sacré-Shop invites the buyer to refer to the description of each item to know the precise characteristics.

Sacré-Shop is only responsible for the content of the pages it publishes through its website www.sacre-shop.ch.

In case of manifest error between the characteristics of the article and its representation and / or conditions of sale, Sacré-Shop can not be held responsible.

The items offered comply with current Swiss legislation. Sacré-Shop declines all responsibility for any misuse of the articles, as well as for any misinterpretation of the texts or statements made by the authors.

13 – APPLICABLE LAW – DISPUTES

This contract is subject to Swiss law.

The language of this contract is French.

In the event of a dispute, the Swiss courts shall have exclusive jurisdiction.

14 – PERSONAL INFORMATION AND DATA PROTECTION

Information and data concerning the purchaser are necessary for order management and commercial relations. In accordance with the law, the buyer has the right to access and rectify any personal data concerning him or her. Simply modify the data in the buyer’s account.

Sacré-Shop guarantees the confidentiality of the information given at the time of the order. They are used to process the order as efficiently as possible. This information may not be communicated or sold to third parties. Sacré-Shop declines all responsibility in case of hacking despite all precautions taken to avoid this problem. Sacré-Shop reserves the right to send advertising information about the store.
